Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites operated by Henna & Harmony ("Henna & Harmony," "we," "us," or "our"), including hennaandharmony.com (the "Site"), the planning application at hennaandharmony.app (the "App"), the vendor directory, the real-wedding archive, planning resources, and any features we offer through them (collectively, the "Services"). By accessing or using the Services you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old to use the Services. If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Accounts
- You are responsible for keeping your account credentials confidential and for all activity under your account.
- You agree to provide accurate information and to keep it current.
- We may suspend or terminate accounts that violate these Terms, that we reasonably believe to be fraudulent, or that remain inactive for an extended period.
3. License to use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal wedding planning or for the legitimate business purpose of operating your vendor listing. The Services, including all software, design, text, graphics, and trademarks, are owned by Henna & Harmony or its licensors and are protected by intellectual-property laws. Nothing in these Terms transfers ownership to you.
4. Acceptable use
You agree not to:
- Violate any law or third-party right;
- Scrape, crawl, or use automated means to extract data from the Services without our prior written permission;
- Reverse engineer, decompile, or attempt to derive the source code of the Services;
- Interfere with the security, integrity, or performance of the Services, including by probing, scanning, or testing vulnerabilities without authorization;
- Upload viruses, malware, or any content designed to harm users or systems;
- Use the Services to send spam or unsolicited commercial messages, or to harass, threaten, or harm anyone;
- Impersonate any person or entity or misrepresent your affiliation with one;
- Use the Services in a way that infringes copyrights, trademarks, rights of publicity, or other intellectual property; or
- Resell, sublicense, or commercially exploit the Services except as expressly permitted.
5. Your content
"Your Content" means any text, images, video, audio, or other material you submit to the Services, including vendor-profile content, wedding submissions, photographs, inquiry messages, and contact-form messages.
- You retain ownership. You own Your Content.
- License to us. You grant Henna & Harmony a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt, publish, display, perform, and distribute Your Content on the Services and on Henna & Harmony social media channels for the purposes of operating, promoting, and improving the Services, including editorial features in the real-wedding archive. This license continues for as long as the content remains on the Services and for a reasonable archival period afterward.
- Your representations. You represent and warrant that: (i) you own Your Content or have all rights, licenses, consents, and permissions needed to grant the license above; (ii) Your Content does not infringe any third-party right; and (iii) if Your Content includes identifiable individuals, you have their permission to share the content for editorial use.
- We may decline or remove content. We may refuse, edit, or remove any content at our discretion, including content that violates these Terms or that, in our editorial judgment, is not a fit for the archive.
6. Wedding submissions
Couples may submit their own wedding, and creative partners — photographers, videographers, planners, and others — may submit weddings they worked on. Before submitting, you must confirm the consents shown in the submission form, including the right to share the photographs and the consent of the couple where you are not the couple.
- Submissions are subject to editorial review, which typically takes two to three weeks. We may request higher-resolution imagery or additional details, and we decide whether and how to publish.
- Published features include credits for the creative partners identified in the submission. Couples' written responses are treated as editorial material; the public page may use a public title and summary written by our editorial team rather than verbatim responses.
- We may decline to publish, remove a published feature, or remove specific images at our discretion, particularly if a consent issue or rights dispute arises.
- Couples and copyright holders may request removal of a submission or published feature at any time by emailing hello@hennaandharmony.com.
7. Vendor directory
- Unclaimed listings. We may create vendor listings based on publicly available business information so the directory is useful from day one. Until a vendor claims the listing, it is limited to that public information.
- Claimed listings. Vendors may claim a listing or create a new one. Claiming requires verifying control of the business and is subject to admin review. By publishing or maintaining a listing, you confirm that the information is accurate, that you have the right to display the photographs and other content used, and that you will fulfill commitments described in your profile.
- Vendor inquiries. When a couple sends an inquiry, you agree to respond promptly, to comply with applicable consumer-protection laws, and not to use inquiry contact details for unsolicited marketing.
- Editorial control. We may decline to publish, unpublish, or remove a listing, including for inaccurate information, complaints from couples, or other reasons consistent with these Terms.
8. Fees and payments
Some features may require payment. Prices, billing cycles, and refund terms for those features are described on the page where you purchase them. Unless stated otherwise, subscription fees are billed in advance and are non-refundable except where required by law. You authorize us, and our payment processors, to charge the payment method you provide on the schedule described at checkout. We may change prices on a prospective basis with reasonable notice.
9. Third-party services
The Services may link to or integrate with third-party services, including Google Maps, Instagram, and external vendor websites. We do not control those services and are not responsible for their content, terms, or privacy practices. Your use of third-party services is governed by their own terms.
10. Copyright complaints (DMCA)
We respect intellectual-property rights and respond to clear notices of alleged copyright infringement. If you believe content on the Services infringes your copyright, please send a notice to hello@hennaandharmony.com with the following information:
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material on the Services that is claimed to infringe, with enough detail (such as URLs) for us to locate it;
- Your contact information;
- A statement that you have a good-faith belief that the contested use is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf; and
- Your physical or electronic signature.
We may forward valid notices to the affected user and may remove or disable access to the material identified. We may terminate accounts of repeat infringers.
11. Privacy
Our Privacy Policy explains how we collect, use, and share personal information. By using the Services you agree to the practices described there.
12. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Services will be uninterrupted, secure, accurate, or error-free. Henna & Harmony does not endorse any vendor listed in the directory and does not guarantee the quality, safety, or legality of any goods or services provided by a vendor.
13. Limitation of liability
To the fullest extent permitted by law, Henna & Harmony and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or in connection with the Services or these Terms, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars.
14. Indemnification
You agree to indemnify, defend, and hold harmless Henna & Harmony and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (i) Your Content; (ii) your use of the Services; (iii) your breach of these Terms; or (iv) your violation of any law or any third-party right.
15. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. You may stop using the Services at any time. Sections that by their nature should survive termination — including content license, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The parties agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that is not subject to arbitration. Either party may instead elect to resolve a dispute through binding arbitration administered by a recognized arbitration provider under its then-current rules. To the extent permitted by law, any dispute will be brought only in an individual capacity and not as a class, collective, or representative action.
17. Changes
We may update these Terms from time to time. Material changes will be highlighted on the Site and, where appropriate, sent by email. The "Effective Date" at the top of this page reflects the latest version. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
18. Miscellaneous
These Terms, together with the Privacy Policy and any other terms referenced here, are the entire agreement between you and Henna & Harmony with respect to the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
